Women’s Human Rights Cases*

To aid feminist advocates in the use of international human rights treaties in litigation, IWRAW Asia Pacific has compiled a number of cases that use and interpret international human rights treaties. These have been chosen based on their relevance to issues of gender equality. Also, all share a positive outcome for women’s rights and equality.

Involving the use of international human rights treaties by various courts on many different levels, the cases fall into three basic categories:

  • National courts referring to international human rights treaties when making decisions;
  • Regional human rights courts or commissions consulting regional and/or international human rights treaties; and
  • The Human Rights Committee hearing cases under the Optional Protocol to the International Covenant on Civil and Political Rights.
    For convenience, the cases chosen have been organised by subject matter.
